SCOTUS has issued poor rulings that are detrimental to democracy . They have also ruined their own integrity and reputation. This is true on a global scale. They’re no longer an esteemed cabinet. They’re simply puppets.

If “birthright citizenship” for was created for ALL babies born here before and after 1865, why was it necessary for Congress to pass The Indian Citizenship Act of 1924, 59 years after they passed the 14th Amendment?

Why didn't the “birthright citizenship” clause originally apply to Native Americans? 👇🏻👇🏻👇🏻👇🏻

Because native Americans were members of their own sovereignty and had their own laws and court systems. This was the first step in allowing citizenship with voting rights as more native Americans became integrated into the rest of society.

That's correct. They inherited the sovereignty of their parents, thus they were not technically “subject to the jurisdiction thereof” which is the qualifying portion of the 14th.

And that is precisely why a baby born to a mother here without legal permission cannot be said to be “subject to the jurisdiction” of the United States.

We both know that the original intent of that portion of the 14th was to vest newly-emancipated slaves and their descendants with full citizenship because they lacked any formal legal status under the laws of this nation.

Immigrants don’t come to our country to join sovereign nations. This is not comparable. If Congress was serious about fixing immigration and citizenship issues, they would have passed the bipartisan bill that represented months of work and addressed them all. DT told them not to because he had plans, big plans.🤦‍♀️

You're correct. And given that “immigrants don’t come to our country to join sovereign nations”, and therefore they retain their allegiance to their country of origin, why should we reward those of them who came here WITHOUT our permission by bestowing citizenship on a baby they happen to drop on our soil?

In the late 18th and early 20th centuries we allowed that practice because we NEEDED more people; particularly to populate the new states and territories west of the Mississippi.

Those days are long gone.

If you think they are only causing pain for immigrants you have not been paying attention. SCOTUS has made the judiciary political to the hard right setting the state for a good judge and a good congresswoman to be arrested and a US Senator to be knocked down and handcuffed for trying to ask a question. Due process and precedent are on life support. Etc.

I watched the oral arguments for this case back in May. Those challenging the administration’s stance presented compelling reasons to uphold the nationwide injunction—especially in response to an unconstitutional executive order like this one. One of the key arguments was that without nationwide injunctions in cases like this, individuals without the resources to hire legal representation are left at a severe disadvantage when defending their constitutional rights.

I’m overwhelmed with disgust. With each ruling, it becomes more apparent that our Supreme Court is failing in its duty to ensure that each branch of government respects the limits of its power.

So is it time for us all to contact our states’ Attorney General to ask them to actively cooperate with the other states’ Attorneys General in starting the process of nullifying this Supreme Court decision regarding birthright citizenship?

The language in the Constitution is quite clear. And the Constitution applies to ALL the states, ALL the people ALL the time, not just some states or sometimes. The Supreme Court’s gamesplaying to coddle the president is unwarranted, unprofessional and undignified. The people of the United States see the ruse and find it unacceptable. The decision clearly violates the Constitution and must be nullified immediately. By the people, by the states, through our Attorneys General. Those Attorneys General have more power than we know. AND they are our conduit for exercising the “power of the people” over our government. They will agree the decision is unconstitutional. Nullification was used by Thomas Jefferson in Virginia and James Madison in Kentucky for the same reason, an unconstitutional law. All elected officials work for us. We, the people, are the boss. The Supreme Court and the president might not like being reminded of that but it is true.

It was probably outlined in Project 2025. Every move the regime is making so far is in that Playbook Document. So the Federalist Society in conjunction with Heritage Foundation probably wrote the framework—possibly, the whole decision.

The highest court in the land has the last word for what is right. Now it seems what is right has blurred. I miss RBG more and more everyday.

I would never have expected to stop respecting, The Supreme Court, I’ve lost respect for them, when they stopped allowing truth to be governed by the Constitution and protecting our country.

Just like are elected officials aren’t protecting the constitution as they all swore to protect against foreign and DOMESTIC enemies.

I don’t understand. What is the end game? Destroy the United States. When did the constitution stop being the “Law of the Land” That document is absolute and when it isn’t that’s what amendments are supposed to protect us as our country is evolving.

Question, how many people think the statue of liberty is going to be taken down ? Her words are starting to lose their meaning, along with the constitution.

A handful of people are ruining our country. Does anyone know which handful I’m referring to? It’s the ones with no integrity, even when everyone is watching. I’ve never thought of myself as naïve. I just wish I didn’t feel so betrayed and fearful.

What happened to the legal mind of John Roberts? He’s been the Chief for many years but since Trump his writings and rulings have veered sharply into a legal abyss. Thomas & Alito I understand to be partisan hacks, but Roberts manned the court based on historical precedent and a fair degree of common sense. He is now acting as Trump’s paid lackey carving out new law, new exceptions just for him and Trumps fevered wishes. It defies logic. At this rate the republic will be in ruins. How will history rate Justice Roberts? As the leader who helped drive the country to its ultimate destruction? He is a sad and illegitimate judge and he along with the others in the Republican swamp should be impeached and removed from office. If you voided the constitution then you and your band of criminal judges should be eliminated. There is no other choice.

I am fortunate for now as I do not live in the US. Everywhere it is best to pace ourselves and study non violent resistance and take care of yourselves Psychopaths seem to have a survival advantage in chaotic situations because they do not care. People who care are at risk of anxiety and depression and all kinds of illness. So be careful, find support and do not take unnecessary risks and do not despair.

Brilliant analysis. I live in the UK and it is frightening how the US is decending into authoritarianism in so many ways, and this turbo charges what the rapidly facistic Trump administration wants to do. It is so shameful. I watch the US with extreme sadness as it is so powerful in the world, and where it goes others follow, including the UK, who toady up to Trump and thereby are complicit in what Trump, his enablers and Project 2025'ers are doing. Under current and past citizenship law, if ONE parent is a full or naturalized US citizen, their children are full citizens at birth.
